What To Do If You’re In a Car Accident

Involved in a car accident? Here are some tips you should consider:

  1. Call 911 if there are any injuries.
  2. If you suspect you may be injured, let 911 know and get checked out immediately at an ER.
  3. Call the police to investigate the crash, even on small fender benders. It may affect the value of your claim.
  4. Contact Ralph The Lawyer, and our investigation team will be on scene within minutes.
  5. Take pictures of all vehicles and the scene if you are able. Email them to me ASAP. (Or use the Ralph The Lawyer Crash App.)
  6. Take pictures of any skid marks. They will disappear when it rains. Email them to me ASAP.
  7. If the police don’t investigate the crash, make sure you get the other driver’s name, address, telephone number and insurance information. Also, get the contact information of any witnesses to the crash.
  8. If you don’t get medical treatment within 14 days of the crash, you will lose important insurance benefits. If you didn’t get emergency treatment after the crash, but feel you may have some injury – no matter how small — I recommend getting checked out by your primary care physician or local clinic or urgent care center within 14 days of the crash.
  9. Depending on your coverage, your insurance company should pay for a rental car and your car repairs. They may get reimbursed from the other driver’s insurance.
  10. If you don’t have coverage for a rental car or car repairs, you may have to wait until the other driver’s insurance company concludes their liability investigation. This can take weeks.
  11. If your car is a storage yard, pay the tow charges yourself and get it out of storage as quickly as possible, if you can. They can charge per day storage and that will eat up your settlement recovery. If you don’t pay them, they can sell your car to pay the bill!

After the injury, the insurance company adjuster for the other driver will call you and try to get a recorded statement. DO NOT GIVE ONE. It will only be used against you later. Call me if they try to do this.

They will also ask you to sign a Medical Release. DO NOT SIGN ONE until you speak to me.

While you have a duty to cooperate with your own insurance company in their investigation, there are limits as to what they can do. I can only cover so much here, so call or email me if you have any other questions.

After an accident, insurance companies are already working against you. It’s in their nature. While they may say they will “take care of you,” or “you don’t need a lawyer,” stop and think about those statements. They are in the business of making money –- it’s in their corporate charters! They bring in money by charging you insurance premiums, and they pay out money in insurance claims. The more money they save by lowering your claim value, the more money they keep to buy skyscrapers and make expensive TV commercials starring animated geckos.
